1. Nature of the Works
All pieces are original works of art or limited editions, not mass-produced or replaceable.
Some works may show signs of aging, craquelure, oxidation, natural patinas, or other time-related wear, which are not considered defects but rather an inherent part of their history and authenticity.
If a frame is included, it may present wear, marks, scratches, or minor damage from handling or transport. The frame is provided as a courtesy and not as an essential part of the work, unless expressly stated otherwise.
It is the buyer’s responsibility to carefully read the description, dimensions, and technique before purchasing. We recommend scheduling an appointment to view the piece in person if further certainty is required.
2. Prices, Taxes, and Commissions
Published prices do not include VAT or other applicable taxes.
VAT, additional taxes, and processing fees may vary depending on:

The customer’s shipping location.

The type of work.

The payment method (credit card, bank transfer, platforms such as Stripe or PayPal).
These charges may not be automatically reflected at the time of purchase; therefore:
We reserve the right to quote and charge these amounts separately, in direct communication with the customer before confirming shipment or delivery.
3. Shipping, Insurance, and Packaging Costs
Shipping, insurance, and packaging are not included in the published price of the work.
These costs may vary significantly depending on:

The size, weight, or fragility of the piece.

The technique and material (glass, ceramics, mixed media, etc.).

The need for wooden crates, special packaging, or professional handling.

The domestic or international destination of the shipment.
Some pieces cannot be shipped via standard courier services and require specialized art transport.
Arte Actual Galería reserves the right to quote and charge these costs separately, directly to the buyer.
If the buyer chooses not to cover the costs of specialized packaging and shipping, the gallery may cancel the order and refund the amount paid (minus non-recoverable commissions).
4. Gallery Pickup
The buyer may choose to personally collect their work at Arte Actual Galería (San Pedro Garza García, N.L.) by appointment. An official ID and order confirmation will be required.
5. Payment Methods
We accept credit/debit cards, bank transfers, and cash payments (in-gallery only).
Payments made through platforms such as Stripe or PayPal may incur additional fees, which will be charged to the customer when applicable.
6. Exchanges, Cancellations, and Refunds
All sales are final.
No returns, cancellations, or exchanges are accepted unless the work arrives damaged during transport and was insured.
Claims will not be accepted for:

Subjective perception (“it wasn’t what I expected,” “it doesn’t match,” “I thought it was bigger”).

Minor imperfections in frames or non-essential supports.

Damage or wear previously visible or described.

Change of mind or ordering errors.
7. Damage During Shipping
If the customer purchased insurance and the work arrives damaged:

They must notify us in writing within 48 hours of delivery.

Provide clear photographic evidence and keep the original packaging.
Arte Actual will handle the claim with the insurer, acting as an intermediary, but does not guarantee a favorable outcome, as it will depend on the insurer’s assessment.
If no insurance is purchased, the customer assumes full responsibility for any loss, damage, theft, misplacement, or deterioration during transport. In such cases, Arte Actual Galería is fully released from any obligation or subsequent claim.
8. Certificate of Authenticity and Limitation of Liability
All works include a certificate of authenticity issued by the artist or by Arte Actual Galería.
Arte Actual is not responsible for:

Natural variations in materials over time.

Mishandling or improper exposure by the buyer.

External revaluations, market speculation, or investment expectations.

Claims related to the aesthetics, interpretation, or emotional impact of the work’s content.

Failures of shipping systems or third-party platforms.
9. Privacy
All personal data will be treated confidentially, in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties.
We do not share your information with third parties, except when necessary for payment, shipping, or invoicing processes.
10. Invoicing
If you require an invoice, you must request it within the same tax month in which payment was made, sending your complete information to: admin@arteactual.art.
Invoices will not be issued after this period.
11. Modifications
Arte Actual Galería may modify these policies at any time. The version in force will be the one published on this site at the time of purchase.
